Terms of Service

1. Acceptance of Terms

By accessing or using the TheraLog application and website (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the Service.

2. Professional Eligibility and Use

TheraLog is designed exclusively for registered healthcare professionals ("Practitioners").

  • You are a certified healthcare professional registered with the relevant statutory body in South Africa (e.g., HPCSA).
  • You possess a valid practice number where applicable.
  • You will use the Service solely for lawful, professional clinical purposes.

TheraLog is a software tool and not a healthcare provider. You remain solely responsible for all clinical decisions, diagnoses, treatments, and record-keeping obligations.

3. Client-Side Encryption and Data Loss Acknowledgment

  • Clinical notes are encrypted on your device using a key derived from your Secure Session PIN.
  • We do not store or have access to your PIN or encryption keys.
  • If you forget your PIN, we cannot recover or reset it.
  • Encrypted notes may become permanently inaccessible if your PIN or local key material is lost.

TheraLog shall not be liable for data loss resulting from lost PINs, device failure, synchronization issues, or local storage clearing.

4. Subscription, Billing, and Payments

A. Subscription Plans

TheraLog is a subscription-based service. New accounts include a 30-day free trial with no credit card required. At the end of the trial period, you may select a plan and provide payment details to continue. Billing cycles may be monthly or annual depending on your selected plan.

B. Payment Processing

Payments are processed securely through PayFast (Pty) Ltd. TheraLog does not collect or store your credit card details.

C. Automatic Renewals

Subscriptions renew automatically at the end of each billing cycle unless cancelled prior to renewal.

D. Cancellation and Refunds

You may cancel at any time. Your account remains active until the end of your billing cycle. Payments are non-refundable unless required by South African law.

E. Price Changes

We may adjust pricing with at least thirty (30) days' notice. Changes take effect at the start of the next billing cycle.

F. Suspension for Non-Payment

If payment fails, we may suspend account functionality until outstanding amounts are settled.

5. POPIA Compliance

Under POPIA, the Practitioner acts as the Responsible Party and TheraLog acts as the Operator.

You are solely responsible for obtaining lawful patient consent and ensuring compliance with applicable data protection laws.

6. Acceptable Use

  • Do not share credentials or Secure Session PINs.
  • Do not attempt to reverse engineer the Service.
  • Do not upload malicious or unlawful content.
  • Do not use the Service in violation of South African law.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

8. Limitation of Liability

To the maximum extent permitted by law, TheraLog shall not be liable for indirect, incidental, or consequential damages, including loss of data or professional claims.

Our total liability shall not exceed the total fees paid in the twelve (12) months preceding the claim.

9. Force Majeure

We are not liable for failures caused by events beyond our reasonable control, including power outages, internet failures, cyberattacks, or governmental actions.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Disputes shall be subject to South African courts.
